Who owns your song or remix on Remixin?

Short answer, you do!

Rob Parke from the band Lightnight Inside You sent us this question about ownership of the music on Remixin. He was concerned after the recent Facebook fiasco. As you may know they changed their legal agreement to allow them the option to use your content to sell products and services.

"With all the recent Facebook TOS / ownership issues of late, it's made us thing more about rights when we upload music to sites while balancing it with getting it out to as many people as possible. How do the rights work with respect to your site as well as the remixers? Can remixin.com, for example, license songs, use them for promotion or compilation without artist consent?" - Rob Parke

Songs and Remixes uploaded to Remixin are owned by their creators. Remixin gets no ownership of your music. We are only granted the right to host and stream the song on our site via a creative commons license. All songs uploaded to remixin carry a creative commons license. This is important as it allows others to download your music and remix it.

This is the creative commons license we use:

It is a non-commercial sampling plus license. Artists still retain all the rights, but the license lets others legally remix your work. People cannot use your work commercially without your consent.

Remixin is set up to help musicians. It is not here to take your hard work and try to resell it. By allowing your song to be on the site and carry the creative commons license new doors are open to your music since others can remix it and spread your work through these remixes. It's a great opportunity to get new fans and get inspiration from what others do with your music.

In terms of the remixers themselves. They can post their remixes of your work on their own site or blog, but they CANNOT sell it without written consent from the original creator (ie the original band or musician). Remixers must also give credit to the song they are remixing. On the Remixin site itself every remix lists what song it is a remix of and it links directly to that original song. If the remixes get lots of hits this is a good thing for the creator of the original. The creator of the original song can always sell or license their music regardless of it being on Remixin, they own it afterall.

I hope this clears things up. We are building Remixin to be a creative and promotional tool for artists. We are not trying to license the music or use it for promotion without the artists' consent. We hope people supplying music or remixes to Remixin will get future gigs from the exposure they get on our site.
